FOX is premiering it’s highly anticipated “Empire” on January 7th. The showing, Terrence Howard and Taraji P. Henson, has hit a roadblock in the form of a cease and desist order.

Philly native Steven Gordon has filed the suit claiming that the musical drama is “whole or in part” based on the film Must Be the Music. Gordon and his team filed the suit citiing “irreparable harm and damage to the viability of his project” against the show’s creator and executive producer Lee Daniels as well as executive producers Bryan Grazer, Danny Strong, and Francie Calfo.

Gordon addressed the issue saying, “It’s always wonderful when the public gravitates to and appreciates your efforts. In this case, powerful filmmakers such as Lee Daniels have noticed my hard work but not as I would have wanted them to. This is a winning idea and I have more to offer.” So far, FOX has not commented.
