CBS News reported about how an officer’s response to a trespassing call turned violent when he arrested a suspect. 

Aurora officers John Haubert and Francine Martinez responded to a report of a break-in on July 23. They located Kyle Maurice Vinson, 29, along with two other suspects in the 3100 block of South Parker Road. According to court documents, police were instructed to sit the suspects down so that they could run through their records, but they fled, leaving Vinson behind. 

In a video released recently, additional details are revealed about what transpired during the arrest. 

Vinson can be seen being cuffed by Haubert at gunpoint in one portion of the body cam footage, being ordered to get down on the ground and having his hands raised. The suspect is then grabbed by one hand as he points the gun at Vinson with the other hand. Haubert hit the suspect a few times, causing blood to leak from his forehead as a result of his resistance to being placed in handcuffs. In the case of further resistance, he threatened to shoot him. 

Despite blood dripping from his head, Vinson, who was not caught fighting the police, pleaded with officers. “Don’t shoot me, I didn’t even move,” he replied. “Don’t hurt me, bro. Don’t shoot me, please,” he added. At one point, he told the cops, “You’re killing me.” Haubert continued attacking the suspect despite his complaints, allegedly hitting him and choking him until he became unconscious. A second officer tased him after arriving on the scene. 

After being treated for cuts and receiving a few stitches, the 29-year-old suspect was transported to a local hospital for treatment. Since he violated the terms of his probation, it is unclear whether he will be punished. The charges against Hauser, however, did not only include assault with a deadly weapon, causing serious bodily injury, but also felony strangulation, felony menacing, official misconduct and official oppression. Haubert’s partner, Martinez, faces charges as well after he failed to intervene and reported Haubert’s excessive force against Vinson.
